The purpose of these General Terms and Conditions of Use (hereinafter referred to as the 'GTCU') is to determine the rules of access and the conditions of use of the 'PaycashPay' platform, published by the company 'ITSDB CENTER LLC'.
By accessing the platform, as a visitor and/or user, the Internet user, whether an individual or a legal entity, acknowledges that he/she has read and accepted all of the following provisions without restriction or reservation. Any visit to and/or use of PaycashPay must be in accordance with these GTC.
PaycashPay is a secure online payment platform. PaycashPay is an intermediary, a third party who makes the connection between the e-business man, online business or a traditional business that wants to be paid on the internet and its customer for the payment of a service or a good. It brings together all digital payment services (Bitcoin, Litecoin, Dash, Doge and Visa, Mastercard) in a single online payment interface. PaycashPay also allows individuals to receive payments from other individuals using PaycashPay.
With PaycashPay, payment is made quickly and the customer does not need to create an PaycashPay account.

The user expressly recognizes that the site and the contents (images, marks, logos) are the exclusive property of the editor and are protected by the code of the Togolese or American intellectual property as well as the treaties and the applicable international agreements on the matter. Consequently, any reproduction, representation, adaptation, translation and/or partial or integral transformations, or transfers towards another site, without the written, express and preliminary authorization of the editor, are prohibited.
You may not assign any rights or obligations or transfer your PaycashPay account to any third party under this Agreement without the prior written consent of PaycashPay.
Any notification or other information from PaycashPay will be sent to your e-mail address.
Except for notices relating to changes to this Agreement, you will be deemed to have received any notice sent by us within 24 hours of it being sent by email.
You can access details of completed payment transactions and other information about your transaction history in your account.

PaycashPay shall not be used under any circumstances for activities:
• that violates any law, contract, ordinance or regulation;
• in connection with transactions involving products that pose a risk to consumer safety; drugs and related items; illegal items or items intended to encourage, promote or facilitate illegal activities or instruct others how to conduct them; items that advocate hatred, violence, racial intolerance or the financial exploitation of criminal acts; items that may be considered obscene in nature;
• that involves the sale of products or services identified by government agencies as having a high probability of fraud;
• in connection with and/or financing of terrorism.
We offer a Digital Transaction API that your technician implements by following the integration guide in your dashboard.
Balances are available immediately after transaction confirmations.

You are responsible for all claims, expenses, fines and liabilities arising from :
• a chargeback, refund, overpayment, payment error or other invalid payment made by you (collectively, the 'Invalid Payment');
• any error, negligence, misconduct or fraud by you, your employees or anyone acting on your behalf; and
• any loss resulting from your failure to comply with the terms of this Agreement or your use of PaycashPay services. In the event of an invalidated payment or otherwise, we may deduct amounts due to PaycashPay from your payments.
THE PaycashPay PAYMENT SERVICE IS PROVIDED 'AS IS' WITHOUT ANY WARRANTY. PaycashPay DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, WITH RESPECT TO THE MERCHANT IN ANY MATTER, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PaycashPay OR ITS EMPLOYEES OR REPRESENTATIVES SHALL CONSTITUTE A WARRANTY OR OTHERWISE INCREASE THE SCOPE OF PaycashPay OBLIGATIONS.
The parties acknowledge that the PaycashPay payment service is a secure service based on computer programming and a network of servers that may be subject to breakdowns and delays. As such, ITSDB CENTER LLC does not guarantee continuous or uninterrupted access to PaycashPay payment services. Merchant further acknowledges that access to the PaycashPay website or PaycashPay payment services may be restricted for maintenance purposes by PaycashPay OR PaycashPay PARTNER OPERATORS. PaycashPay will use reasonable efforts to ensure that transactions are processed in a timely manner. However, PaycashPay or ITSDB CENTER LLC shall not be liable for any interruption, failure or failure to provide PaycashPay payment services.
PaycashPay, in it's sole discretion, may place a reserve on a portion of your payments if there is a high risk associated with your business or operations. If we place a reserve on a portion of your payments, we will notify you and specify the terms of the reserve. The conditions may require that a certain percentage of your payments be held for a certain period of time, that a fixed amount of your payments be withheld, or any other restriction that PaycashPay determines in it's sole discretion. PaycashPay may change the terms of the reserve at any time by notifying you of the new terms.
PaycashPay may hold a reserve for as long as it deems necessary, in it's sole discretion, to mitigate the risks associated with your transactions. You agree to remain responsible for all obligations associated with your transactions even after a reserve is released. In addition, we may require you to keep your bank account available for any open settlements, chargebacks and other adjustments.
The non-compliance by the user, regardless of its location, of any of the provisions of these general conditions of use and or their execution, interpretation or validity, are subject to the law and the courts.
The publisher reserves the right, at any time and without prior notice, to modify and update these GCU.
You agree that you are solely responsible for accepting and processing returns of your products and services. We are under no obligation to process returns of your products and services or to respond to your customers’ inquiries about returns of your products and services. You agree to submit all Refunds for returns of your products and services that were paid for through our platform to your customers in accordance with this Agreement and relevant Card Network Rules.
You agree to notify us immediately if any error is detected while reconciling transactions that have occurred using our platform. We will investigate and rectify the errors where verified. In the event that we notice any errors, we will also investigate and rectify such errors.
Where we owe you money as a result of such errors, we will refund the amounts owed to you. If a transaction is erroneously processed through your platform, report it to us immediately. We will investigate any such reports and attempt to rectify the errors by crediting or debiting your Bank Account as appropriate.
Failure to notify us within 30 (thirty) days of the occurrence of an error will be deemed a waiver of your rights to amounts that are owed to you due to an error.
